    Overtime Pay


    Wage and hour claims include claims for unpaid wages, failure to pay overtime and discrimination in the payment of wages, e.g., male employees being paid higher than female employees for the same job.

    For example, all workers in the United States are covered by the federal Fair Labor Standards Act (FLSA). Under the FLSA, unless an employee is specifically exempted, employees must receive overtime pay for hours worked in excess of 40 in a workweek of at least one and one-half times their regular rates of pay. Employers often misclassify employees as exempt rather than nonexempt in order to avoid paying overtime and other wages.
