Overtime Pay & Unpaid Wages

There are state and federal laws that strictly govern the payment of wages to employees, including minimum wage and overtime. Wage and hour claims include claims for unpaid wages, failure to pay overtime and discrimination in the payment of wages, e.g., male employees being paid higher than female employees for the same job.

For example, under state and federal law, unless an employee is specifically exempted, employees must receive overtime pay for all hours worked in excess of 40 hours in a workweek. The overtime rate is one and one-half times an employee’s regular rates of pay. Employers often misclassify employees as exempt rather than nonexempt in order to avoid paying overtime and other wages.

There are also strong anti-retaliation provisions under state and federal wage and hour laws that prohibit an employer from taking any adverse employment action against an employee (e.g., a termination, demotion, suspension, etc.) because the employee has complained about not being paid wages or overtime properly.
